Pursuant to the terms of a plea agreement, defendant entered a plea of guilty to the crime of criminal sale of a controlled substance in the second degree and, as part of the agreement, was sentenced to a prison term of six years to life. Consistent with the agreement, a second criminal indictment (which had been consolidated with the first), charging him with possession of a controlled substance in the third degree and resisting arrest, was dismissed.
