We granted James C. Hurley's application for interlocutory appeal from the trial court's order denying his motion for summary judgment in the action filed against him by Tyrone and Stephanie Brown. The Browns brought suit against Hurley and his son Brian for personal injury and loss of consortium after the car driven by Stephanie Brown collided with a car driven by Brian and owned by Hurley.
