Gray (defendant) was convicted of taking indecent liberties with a child, a violation of former Code § 18.1-215.1 On appeal, defendant contends the trial court erroneously denied his motion to dismiss the indictment, arguing the prosecution violated the double jeopardy prohibitions of the United States and Virginia Constitutions and, further, challenges the sufficiency of the evidence to support the conviction...
