McDavitt filed a complaint under the Federal Employers' Liability Act (FELA), 45 U.S.C. §§ 51-60, against the National Railroad Passenger Corporation (Amtrak) for negligence after he was injured in a train derailment in the Washington Terminal coach yard near Union Station in the District of Columbia.
