Plaintiff was arrested in December 1997 for a number of Vehicle and Traffic Law violations and jailed for three days before he posted bail. Eventually, he was indicted for two counts of felony driving while intoxicated and four traffic infractions. He was convicted in October 1998 of one count of driving while intoxicated (Vehicle and Traffic Law § 1192 [2]) and sentenced to a definite sentence of 11 months.
