In a two-count indictment, Benedict Leng Chee Ow was charged with felony obstruction of an officer and speeding. At trial, the state declined to prosecute the speeding charge, and the jury found Ow guilty of misdemeanor obstruction. On appeal, Ow contends that his conviction cannot stand because the trial court erred in excluding an audiotape from evidence and in charging the jury that the speeding offense was irrelevant to the obstruction charge.
