¶ 1 Defendant Taberone Dave Honie was convicted of aggravated murder, in violation of section 76-5-202 of the Utah Code, and sentenced to death. On appeal, he challenges the constitutionality of Utah's aggravated murder statute, the sufficiency of the evidence introduced at trial to support his conviction, and the trial judge's weighing of the aggravating and mitigating factors in sentencing him to death.
