Following a bench trial, David Perdue was found guilty of driving under the influence of alcohol to the extent it was less safe for him to drive, a violation of OCGA § 40-6-391(a). Perdue was acquitted of driving with an alcohol concentration of 0.08 grams or more pursuant to OCGA § 40-6-391(a)(5).
