Petitioner-employer, the Washington Metropolitan Area Transit Authority (WMATA), challenges a decision of the Office of Appeals and Review (OAR) of the Department of Employment Services (DOES) reversing an appeals examiner's denial of unemployment compensation benefits to Christopher Lizzi and awarding him benefits. The examiner had determined that Lizzi was ineligible for benefits because he had been properly terminated for gross misconduct. See
