This matter comes before the Court on a joint motion of the Defendants' for summary judgment in the above titled 42 U.S.C. § 1983 ("Section 1983") claims filed by Plaintiff Earl Sand, a Virginia prison inmate. The joint motion is filed pursuant to Federal Rule of Civil Procedure (Rule) 56.
