Before the Court is a Motion to Dismiss (doc. # 4) filed by the defendants, William J. Henderson, Postmaster General, and the United States Postal Service ("defendants"), seeking to dismiss the plaintiff's Title VII racial discrimination claim under Fed.R.Civ.P. 12(b)(1) and the plaintiff's Title 39 U.S.C. § 409 erroneous discharge claim under Fed.R.Civ.P. 12(b)(6).
