On August 29, 2000, plaintiff Karen M. Toney ("Toney") filed a four-count complaint against defendant St. Francis Hospital ("Hospital"). Count I of the complaint alleges a breach of a settlement agreement between the parties and was voluntarily dismissed upon an agreement reached by the parties.
