¶ 1. James Earl Jones was originally indicted for simple assault on a law enforcement officer; however, the jury found him not guilty of simple assault. Instead, he was found guilty of resisting arrest. Jones was sentenced to forty-five days in the DeSoto County Jail. Jones has filed a timely appeal from this sentence and presents the following issues: (1) whether the trial court erred in refusing to give Jones's requested jury instruction...
