Terrence WILLIAMS, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Second District.

April 27, 2001.

Attorney(s) appearing for the Case

James Marion Moorman, Public Defender, Bartow, and Ivy R. Ginsberg, Special Assistant Public Defender, Miami, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Ronald Napolitano, Assistant Attorney General, Tampa, for Appellee.

GREEN, Judge.

Terrence Williams was adjudicated guilty of burglary of an unoccupied dwelling and petit theft and sentenced as a prison releasee reoffender. Appellant argues that the Prison Releasee Reoffender Act does not apply to burglary of an unoccupied dwelling. Based upon State v. Huggins, 26 Fla. L. Weekly S174, ___ So.2d ___, 2001 WL 278107 (Fla. Mar. 22, 2001), we agree and reverse.
