This is the second time this case has been before this Court. The case was tried to a jury in 1993. Subsequently, the trial court ordered a new trial. The newtrial order was appealed, and in 1995 this Court reversed and ordered that the jury verdict be reinstated. Third Generation, Inc. v. Wilson, 668 So.2d 518 (Ala.1995).1
