This matter is before the Court on cross motions for summary judgment filed by TPT Transportation Company ("TPT") and HBM River Plant, Inc. ("HBM"), a subsidiary of Hall-Buck Marine, Inc. ("Hall-Buck"). On September 29, 2001,1 the Court, for reasons to be assigned in this opinion, granted HBM's motion for summary judgment2
