OPINION OF THE COURT

JOHN J. CONNELL, J.

The defendant was arrested and arraigned on July 19, 2000 on charges of rape in the first degree, rape in the third degree, incest and endangering the welfare of a child. The case was adjourned to August 3, 2000, at which time the matter was waived to the Grand Jury. The defendant was released on his own recognizance with the consent of the District Attorney.
