Before this court is defendant Health-South Corporation's motion to dismiss the False Claims Act ("the FCA") claims under Federal Rules of Civil Procedure 9(b) and 12(b)(6) and to dismiss the Louisiana Whistleblower Protection Act claim. For the reasons that follow, defendant's motion is GRANTED as to the FCA claims, accordingly, the FCA claims are DISMISSED WITH PREJUDICE. Defendant's motion is DENIED as to...
