This case arises from a personal injury and loss of consortium claim filed by plaintiffs Sheila and Charles Smith against defendants Judy Coffey and David Thompson. In an amended petition, the plaintiffs joined the Missouri Highway and Transportation Commission (MHTC) as a defendant. Thompson settled with the plaintiffs, and the case went to trial with the remaining defendants. The jury returned a verdict for the plaintiffs. MHTC challenges the constitutionality...
