Pending before the court in this constitutional tort action is the motion for summary judgment filed by defendants as to all of the federal claims. Plaintiff Larry Fersner has filed an opposition to the motion and a hearing has been held. For the reasons set forth below and on the record at the hearing, the motion shall be granted and the federal claims shall be dismissed with prejudice. The state law claims shall be dismissed...
