Defendant Spencer Morgan was charged by grand jury indictment on May 29, 1997 with aggravated rape, a violation of La. R.S. 14:42. Defendant pleaded not guilty at his June 9, 1997 arraignment. On July 22, 1997, following a lunacy hearing, the trial court found defendant competent to proceed. On August 10, 1998, defendant withdrew his not guilty plea, and entered a plea of not guilty by reason of insanity. Defendant waived his right to trial by jury...
