When Leon Siegel (Leon) attempted to transfer his ownership of a policy of insurance on his life to his spouse, Carole Siegel (Carole),1 by executing an absolute assignment of his rights under the policy to her, Berkshire Life Insurance Company (Berkshire) refused to recognize the assignment. It did so on the basis that collateral assignees of the policy had not indicated their consent to the transfer by signing release
