HOEKSTRA, Judge.

The prosecution appeals as of right the trial court's order dismissing the charges of assault with intent to do great bodily harm less than murder, M.C.L. § 750.84; MSA 28.279, and third-offense habitual offender, M.C.L. § 769.11; MSA 28.1083, because the victim, defendant's girlfriend, failed to appear to testify at trial. We reverse and remand.
