HUDSON, Judge.
Petitioner appeals from the 23 February 2000 order of the trial court, which affirmed the Final Agency Decision of the Board of Trustees of the Local Governmental Employees' Retirement System (the Board of Trustees) determining that petitioner is not entitled to the Survivor's Alternate Benefit set forth in subsection (m) of N.C.G.S. § 128-27 (1999).
