Robert Wincott was indicted on three counts of engaging in organized criminal activity based on three alleged acts of aggravated robbery. See Tex.Pen.Code Ann. § 71.02 (West Supp.2001). Wincott pleaded not guilty to all charges. The jury found Wincott guilty on two counts of aggravated robbery and one count of organized criminal activity, and assessed punishment at three concurrent prison terms of ninety-nine years each.
