WALKER, Judge.

On 18 December 1997, the Raleigh Police Department received information from a confidential informant that defendant was involved in heroin sales originating from his apartment. Sergeant M.E. Glendy of the Raleigh Police Department set up surveillance and observed the defendant walk out of his apartment, sit briefly in a chair on the porch and then go back inside. He then saw the defendant leave with Darren Miller in a green Acura.
