MARTIN, Judge.

Defendant was tried upon bills of indictment charging him with first degree rape and first degree kidnapping of Juanita McClendon on 12 April 1996. The State's evidence tended to show that McClendon was walking to a friend's house in Charlotte at approximately 1:00 a.m. when she was grabbed from behind. Defendant stuck something sharp in her neck, which she believed was a knife, and grabbed her by the mouth. Defendant pushed McClendon down the street...
