CONNOR, Judge:

A magistrate's court jury found James A. Brown, Sr., guilty of speeding. Brown appealed his conviction to the Court of Common Pleas. The circuit court judge dismissed the appeal because Brown did not serve a timely notice of appeal on the South Carolina Department of Public Safety [SCDPS]. Brown appeals the dismissal. We affirm the decision of the circuit court as modified.
