Defendant-appellant Ryan Roger McDaniel appeals from his conviction and sentence, following a guilty plea, for involuntary manslaughter. McDaniel contends that the trial court erred by imposing the maximum sentence for this offense because the trial court erroneously found that it was the worst form of the offense, a finding required by R.C. 2929.14(C) as a predicate for the imposition of a maximum sentence, based upon uncharged conduct.
