ORDER DENYING MOTION FOR RECONSIDERATION AND CHANGING OPINION

The Respondent has filed a motion for reconsideration herein. The panel has considered the motion and has determined that it should be granted only to the extent of being changed as follows:

(1) On page four, [First column, first full paragraph, line five of page 781 of 29 P.3d] add a footnote to the first sentence of the second paragraph:
