Defendant-appellant, Andrew Sutton, appeals his conviction in the Butler County Court of Common Pleas for murder.

Appellant was indicted in June 1999 on one count of murder in violation of R.C. 2903.02(B) and one count of felonious assault in violation of R.C. 2903.11(A)(1). The charges stemmed from an incident that occurred in the early morning hours of May 15, 1999, wherein appellant and his friend, James McIntosh ("McIntosh"), allegedly assaulted...
