[¶ 1] Randy Eklund (Eklund) was injured when the vehicle in which he was a passenger was rear-ended by a vehicle driven by a co-worker, Terry Tebben (Tebben). The district court concluded that the co-worker was not acting within the scope of his employment at the time of the accident and granted the employer's, PRI Environmental, Inc.'s (PRI), motion for summary judgment on Eklund's claim of vicarious liability on the theory of respondeat superior...
