Opinion of the Court by BURNS, C.J.

Plaintiff-Appellant State of Hawaii (State) appeals the district court's February 10, 20001 Order Granting Defendant's Motion to Suppress for No Reasonable Suspicion to Stop and Oral Motion to Dismiss. We reverse the order granting the motion to suppress, vacate the order granting the oral motion to dismiss, and remand for a new trial by a different judge.
