Appellant, Stephen John Colston, entered a conditional plea of guilty to first-degree battery, in violation of Ark.Code Ann. § 5-13-201(a)(3) (Repl.1997), pursuant to Ark. R.Crim. P. 24.3(b) (2000). The battery charge, a class A felony, was enhanced by Ark.Code Ann. § 5-74-108 (Repl.1997), engaging in violent criminal activity.
