Defendant-appellee Julio A. Pereira ("Pereira") pled guilty to four counts of subscribing false tax returns and twenty-one counts of using the mails for commercial bribery. At sentencing, the district court applied the Sentencing Guidelines and found Pereira's total offense level to be sixteen.
