On May 26, 1999, a federal grand jury sitting in the District of Rhode Island returned a six-count superseding indictment against defendant-appellant Oscar Caba and a codefendant, Manolo Vargas. Counts 1 and 2 charged the men with conspiring together and with others to distribute, and to possess with intent to distribute, heroin and cocaine in violation of 21 U.S.C. § 846.
