GRANT, Justice.

Charles William Boitnott was convicted of the felony offense of driving while intoxicated, subsequent offense. See Tex.Pen. Code Ann. § 49.09(b) (Vernon Supp.2001). Upon evidence that he had two prior convictions for DWI and three prior convictions for felony burglaries, the jury found he was a habitual offender and sentenced him to eighty years in the penitentiary.
