MEMORANDUM—DECISION AND ORDER

Presently before the court is Defendants' motion for summary judgment. For the reasons stated herein, Defendants' motion is denied.

I. BACKGROUND

The present case arose as the result of an automobile accident that occurred on July 17, 1998. On that date, Plaintiffs Shelley Skaler Meyer ("Mrs.Meyer") and Robert Meyer were traveling northbound on the New York State Thruway...
