MIHALAKOS, J.

The petitioner, Lawrence R. Smith, appeals from the judgment of the habeas court dismissing his petition for a writ of habeas corpus. The petitioner claims that the habeas court improperly granted the motion to dismiss filed by the respondent commissioner of correction. We agree and reverse the judgment of the habeas court.
