YEAKEL, Justice.

Appellants Hays County Water Planning Partnership, a political and environmental group of Hays County taxpayers concerned about real estate development in Hays County, and Erin Foster, its chairman, (together "HCWPP") appeal from the district court's summary judgment in favor of appellee, Hays County, Texas. We will reverse the district court's summary judgment and remand the case to that court.
