This case is before us on a petition for rehearing filed by the State of Indiana, requesting that we reconsider our holding in Nurseryland Foundation v. State, No. 45A03-9909-CR-349, 745 N.E.2d 919 (Ind. Ct.App. Mar. 21, 2001).
