MINER v. McKESSON CORP.

No. 2D99-4927.

784 So.2d 1156 (2001)

Robert P. MINER, Appellant/Cross-Appellee, v. McKESSON CORPORATION, Appellee/Cross-Appellant.

District Court of Appeal of Florida, Second District.

Rehearing Denied April 24, 2001.

Attorney(s) appearing for the Case

Susan J. Silverman, Sarasota, and Martin A. Rosen of Rosen & Shapiro, Sarasota, for Appellant/Cross-Appellee.

Dennis R. O'Connor and Warren Kwavnick of Cooney, Mattson, Lance, Blackburn, Richards & O'Connor, P.A., Ft. Lauderdale, for Appellee/Cross-Appellant.

NORTHCUTT, Judge.

Robert Miner tripped and fell at McKesson Corporation's warehouse, then sued McKesson for his resulting injuries. When the matter was tried the jury found both parties were negligent, and it awarded damages to Miner. Then the case went awry: the trial court granted McKesson's motion for mistrial. We treat that order as one granting a new trial, and we reverse it. See Keene Bros. Trucking, Inc. v. Pennell, 614 So.2d 1083
