On May 24, 1995, petitioner, Allen Robinson, pleaded guilty but mentally ill to first-degree murder (720 ILCS 5/9-1(a)(1) (West 1994)), and he was sentenced to 40 years' imprisonment. Petitioner appealed his sentence to this court, arguing that his sentence was excessive. This court affirmed. See People v.
