Following his involvement in an automobile collision, appellant Thomas Wyman Badgett was arrested for suspicion of DWI. He refused to give a blood sample voluntarily, so one was taken at a hospital, allegedly pursuant to § 724.012(b) of the Texas Transportation Code, over his objection.
