The juvenile Defendant, T.J., appeals his conviction of possession of marijuana, a violation of La. R.S. 40:966C. We conditionally affirm the conviction, vacate the sentence and remand.

The Defendant was adjudicated a delinquent on August 8, 2000 for possession of marijuana. He filed a motion for post verdict judgment of acquittal on August 18, 2000. The motion was set for hearing on September 6, 2000, but was continued to November...
