On February 8, 2001, Fredrick Ladon Grier executed a written explanation of rights and a plea of guilty and was convicted of unlawful possession of cocaine, a violation of § 13A-12-212, Ala.Code 1975. On April 10, 2001, the trial judge sentenced Grier, pursuant to the Habitual Felony Offender Act ("HFOA"), to five years in the state penitentiary; that sentence was split and he was ordered to serve one year and one day in the penitentiary followed...
