Plaintiff filed suit in city court to obtain a $1,600 refund for monies paid for an extended warranty that he purchased along with a new automobile. Defendant answered plaintiff's suit and submitted a counterclaim for the $2,500 down payment on the vehicle it claims was never paid by plaintiff.
