STATEMENT OF THE CASE:

On September 1, 1994, the defendant, Everett "Buff" Offray, was charged by grand jury indictment with first degree murder. La. R.S. 14:30. He was arraigned on September 7, 1994, and pled not guilty. He filed a motion to suppress that was denied. On June 4, 1996, a twelve-member jury found the defendant guilty of second degree murder. La. R.S. 14:30.1 He was sentenced July 10, 1996, to life imprisonment...
