The defendant, Winifred T. Spencer, is before this court a second time, complaining of the manner in which the trial court imposed sentence on him. For the following reasons, we grant relief for the second time.

The criminal charge against the defendant arose from a one-vehicle accident which occurred in the early hours of October 18, 1997. In the accident, the defendant sustained severe personal injuries and a passenger, Joseph Toby, was killed...
