STATEMENT OF THE CASE

Defendant, Lee Roy Lowry, was charged on September 22, 1999, in a bill of information with third offense driving while intoxicated (DWI), in violation of La. R.S. 14:98(D). Defendant plead not guilty and filed a motion to quash one of the two predicate pleas upon which the bill of information was based. The motion was denied. Defendant thereafter withdrew his not guilty...
